Privacy Policy

EMS Privacy Policy

Employment Management Services (EMS) is committed to ensuring your information is handled responsibly. Our Privacy Policy adheres to the Privacy Act 1988 (Cth) and ten National Privacy Principles (NPPs) incorporated into the Act under the private sector amendments on 21 December 2001.

The Privacy Act and NPPs were created to set out a minimum standard for information handling. Adherence to the Act and NPPs ensures due attention is paid to the protection of any personal information being handled by a second party, in this case, EMS.

The below Policy outlines how the ten NPPs apply to EMS and the steps we take to ensure your information is handled and stored in compliance with the Act. By using the EMS website, you are consenting to the Terms of EMS’s Privacy Policy.

Please note: all references to Employment Management Services (EMS) encompass the Company, its staff and Directors.

1. Collection:

This Principle relates to any information EMS may collect about you.

EMS will only collect, by fair and lawful means, information that is required for it to carry out its business functions and activities. Where possible, EMS will collect personal information directly from you. On occasions when information is obtained through a third party, EMS will take reasonable steps to inform you the information has been collected.

2. Use and disclosure:

Stipulates that an organisation must not use or disclose personal information about an individual for a purpose other than the primary purpose of collection, unless the individual would reasonably expect the organisation to use or disclose the information for a secondary purpose.

EMS will not disclose or use any personal information for anything other than carrying out its business functions and activities (except when required by law) without the prior written consent of the individual/s concerned. In carrying out its business functions and activities, EMS may disclose your information to third parties such as:
• Prospective employers
• EMS clients considering taking on your services on a contract/temporary basis
• Your nominated referees and previous employers
• Educational or vocational organisations/bodies for the purposes of verifying qualifications and training
• Workers compensation bodies

In any instance where a legal requirement necessitates the disclosure of personal information, EMS will only act after consultation with the Office of the Privacy Commissioner.

3. Data quality:

EMS will, as required by the Act, take reasonable steps to make sure that the personal information it collects, uses or discloses is accurate, complete and up-to-date.

If your information has changed, please contact EMS so we can update our records to ensure they remain accurate. EMS may also contact candidates and clients from time to time to confirm the accuracy of the information held on file.

4. Data security:

In accordance with this Principle, EMS will take reasonable steps to protect your personal information from misuse and loss and from unauthorized access, modification and disclosure.

Upon receipt of a written request from you, EMS will take reasonable steps to destroy or permanently de-identify your information if it is no longer needed for any purpose for which it was originally collected.

5. Openness

This document (EMS Privacy Policy) is available online and can be supplied in electronic or hard-copy upon request. The document has been set out to clearly express EMS’s policies on its management of personal information. 6. Access and correction

In instances where an individual submits a written request for access to their personal information, EMS will usually honor their request, provided due notice is given and that the request is reasonable and outside the restrictions set out in the Act. Should evaluative information which has been internally generated by EMS in connection with a commercially sensitive decision making process, EMS may explain the commercially sensitive decision to the individual, rather than provide them with direct access to the information.

In cases where EMS is not required to provide the individual with access to information relating to a commercially sensitive decision making process, EMS may consider the use of mutually agreed intermediaries to allow sufficient access to meet the needs of both parties.

If you are able to establish the personal information EMS holds about you is not accurate, complete and up-to-date, EMS will take reasonable steps to correct the information upon receipt of a written request and verifiable data.

EMS will always provide (and record) reasons for denial of access or refusal to correct personal information.

7. Identifiers

EMS does not use identifiers for individuals i.e. EMS does not assign individuals with a number for identification purposes.

8. Anonymity

Wherever it is lawful and practicable, individuals have the option of not identifying themselves when entering transactions with EMS.

9. Transborder data flows

EMS will only transfer personal information to a third party in another country when prior written consent has been obtained by the individual. EMS will take reasonable steps to ensure that the information will not be held, used or disclosed by the recipient inconsistently with the NPP.

10. Sensitive Information

Any sensitive information collected by EMS will be handled in accordance with current legislation.
